RELEASE AND WAIVER OF LIABILITY

RELEASE and Waiver of Liability (hereinafter Release)

Referred to as STUDENT, Attending the class.

For and in consideration of permitting the STUDENT to enroll and participate in the course offered by  National Rescue Consultants, L.L.C., and participate in the activities and instruction given and conducted by, National Rescue Consultants L.L.C., referred to as the TRAINING PROVIDER, in the County of Lee, Florida. STUDENT voluntarily releases, discharges, waives, and relinquishes all claims of liability against the TRAINING SITE PROPERTY AND ALL PROPERTY OWNERS, the TRAINING PROVIDER , and its officers, employees, agents and or other STUDENTS including but not limited to any all actions or causes of action for personal injury, medical bills, loss of income occurring to STUDENT or anyone else,  or death of STUDENT or anyone else or property damage occurring as a result of engaging or receiving instruction at the TRAINING PROVIDER, in any activities or instruction incidental thereto or merely as the result of being enrolled at the TRAINING PROVIDER, wherever or however any such personal injury or death or property damage may occur, whether by the negligence of the TRAINING PROVIDER or any of the TRAINING PROVIDER’S officers, agents, servants or employees, or otherwise. And, for the entire period that the STUDENT is enrolled at the TRAINING PROVIDER or participating in activities or instruction at the TRAINING PROVIDER’S on site or off site locations. STUDENT assumes full responsibility for all risk of bodily injury, death, or property damage caused by the negligence of the TRAINING PROVIDER, or any of the TRAINING PROVIDER’S officers, agents, servants or employees, or otherwise, or by STUDENT or any other STUDENTS while enrolled at the TRAINING PROVIDER or engaged in any activity or instruction with the TRAINING PROVIDER. STUDENT does for himself or herself, and his or her heirs, executors, administrators, personal representatives and assigns release, waive, discharge, and relinquish any action or cause of action for personal injury, death or property damage that may arise from being enrolled at the TRAINING PROVIDER or participating in any instruction or activities conducted by the TRAINING PROVIDER, and agrees that under no circumstances will the STUDENT prosecute or present any claim for personal injury, death, or property damage against the TRAINING PROVIDER or any of the TRAINING PROVIDER’S officers, agents, servants or employees for personal injury death or property damage arising from enrollment at the TRAINING PROVIDER or from participating in any activities or instruction conducted by the TRAINING PROVIDER, whether such personal injury, death or property damage be caused by the negligence of the TRAINING PROVIDER or any of the TRAINING PROVIDER’S officers, agents, servants or employees, or by STUDENT or any other STUDENT, otherwise.

The STUDENT, for him or herself and his or her heirs, executors, administrators, personal representatives, and assigns agrees that in the event that any claim for personal injury, death, or property damage shall be prosecuted against the TRAINING PROVIDER its officers, employees and agents and or other STUDENTS on behalf of the STUDENT or his or her heirs, executors, administrators, personal representatives and assigns, the STUDENT shall indemnify and save harmless the TRAINING PROVIDER from any and all such claims or causes or action by whomever made and wherever and whenever presented, and further agrees to indemnify TRAINING PROVIDER, its officers, employees and agents from any monetary damages including costs and attorney fees, defend any and all claims  whether in a Court of Law or otherwise brought against TRAINING PROVIDER, its officers, employees, and agents and or other STUDENTS. STUDENT acknowledges that in any action brought filed in Court to enforce the terms of this Release shall be in a Court of competent jurisdiction in Broward County Florida.  The STUDENT acknowledges that he or she has read this release and that he or she is aware that  engaging in the activities and instruction offered by the TRAINING PROVIDER may involve activities that are dangerous or may become dangerous. In addition he or she is fully aware of the legal consequences of signing this release. CERTIFICATION I HEREBY CERTIFY that on the day first written above, the above named STUDENT was provided a full opportunity  to read or has had the opportunity to have the Release read to him or her, that he or she states that he or she that this is  a Release and the nature of a Release, and that he or she agreed that by signing the Release he or she intended the result of such a document.
